Federal district court sanctions motions.
The day of service is not counted.
Holidays and court closures
Federal holidays under 5 U.S.C. 6103 are always skipped, including the observed weekday when a holiday falls on a weekend.
For weather or emergency closures. Check the court's notice to confirm it extends deadlines.
How the deadline is counted
- Serve the motion first. Under Rule 11(c)(2), the motion goes to the other party but is not filed with the court.
- Count 21 days. If the last day is a weekend or legal holiday, it moves to the next day under Rule 6(a)(1)(C).
- Add 3 days for mail. Rule 6(d) adds 3 days after the period ends when service is by mail. Electronic service adds nothing.
- File the next day if the paper was not withdrawn or corrected.
Worked examples
| Example | Motion served | Deadline |
|---|---|---|
| Electronic service | Mon, Oct 26, 2026 | Tue, Nov 17, 2026 |
| Mail service | Mon, Oct 26, 2026 | Fri, Nov 20, 2026 |
Do not wait too long. Most courts hold that a Rule 11 motion served after judgment, or so late that there is no real chance to withdraw the paper, is improper. The court can also set a different safe harbor period.
