There is NO route of review against a refusal of permission to appeal by the Appeal Panel: PD 3.40, "There is no procedure for seeking a review of that refusal." Corrected on verification: the 2009 comparator was mis-cited. The equivalent provision is 2009 r 9(4), not r 10(4). In the Schedule to SI 2009/224, r 9 is headed 'Procedural decisions' and r 9(4) reads: 'A party may apply for a decision of the Registrar to be reviewed by the Judicial Committee and any application under this rule must be made in the appropriate form and be filed within 14 days of the Registrar's decision.' Rule 10 is headed 'Permission to appeal' and contains no time limit. The 2024 rule and period are unaffected.
