FOIA imposes no statutory internal review at all: s.45(2)(e) only requires the Code to cover "procedures for dealing with complaints about the handling by them of requests for information". An authority may accept a review request after 40 working days and often will; equally it is "not obliged to accept internal reviews after this date". Contrast the EIR, where the 40 working day limit for representations is in the regulations themselves.
