  • Extendable under rule 5(3)(a), but rule 42(4)(b) provides that unless the tribunal extends time "the Tribunal must not admit the application". The tribunal also has express power under rules 42(2A) and (2B) to direct that the 28 days for a preliminary issue decision, or for a rule 25A costs order decision, runs instead from the date of the decision disposing of all issues.
  • The "latest of" construction means a calculator needs up to four candidate dates and must take the maximum. Note that rule 42(2)(c) - notification that a set-aside application was unsuccessful - only counts if the set-aside application was itself made in time under rule 41 or an extension of it (rule 42(3)).
