- No extension power appears anywhere in reg 11. This is the key contrast with FOIA, where the 40 working day review window is only a Code of Practice expectation the authority may waive. Under the EIR the limit is in the regulations, expressed as "shall", so a late request does not engage the reg 11 duty at all - though an authority remains free to reconsider voluntarily, and the Commissioner's s.50 jurisdiction (applied by reg 18) is not itself time-limited.
- The trigger is subjective and unusual for a calculator: it runs from the date the applicant believes non-compliance occurred, not from the date of the authority's response. Where the complaint is a failure to respond at all, the trigger is normally the expiry of the reg 5(2) or reg 7(1) period. Treat the trigger date as a user input, not something derivable.
