- None. Regulation 7 does not apply to reg 11: the extension in reg 7(2) is limited to regs 5(2), 6(2)(a) and 14(2). There is no power to take longer than 40 working days over an EIR internal review, which is a genuine hard deadline unlike its FOIA counterpart.
- The freestanding "as soon as possible" duty sits alongside the 40 working day longstop. Where the authority concludes it failed to comply, reg 11(5) requires the notification to state the failure, the action it will take to comply, and the period within which that action will be taken - so expect a further self-imposed date to diarise.
