How the date is counted

Clear days for the encoded response periods

All calendar days count for periods over five days. An end date on a court closure day moves under CPR 2.8(5).

Exceptions and matter facts

  • Expiry of a date does not by itself establish entitlement to default judgment. Check every condition in CPR 12.3.
  • Different rules apply to claims where default judgment is unavailable or permission is required.
