Calculation basis and source
- Period
- 5 working-days
- Trigger
- The day on which the document is filed through the electronic filing portal, by fax transmission or by email
- Counting
- The encoded calculator method must be independently documented before publication.
- Rollovers and holidays
- Holiday, closure and order treatment must be independently documented before publication.
This route remains in preparation until a pinpoint official source is recorded.
- Rule 6(1) extension or abridgment; r 8(1) dispensing with compliance.
- EXPRESSED IN BUSINESS DAYS, not days - one of only two business-day periods in the Rules. Because the rule says "after the day on which", the filing day itself is excluded. A document filed through the portal, by fax or by email is deemed filed on the day received unless that day is a holiday, in which case it is deemed filed on the following non-holiday day (r 19(3.1)); receipt time is measured in the Eastern time zone (r 19(3.2)). A document filed by hand, mail or courier is deemed filed on the date of the Court's filing stamp (r 19(3)). The Registry is open every day except holidays from 8:00 a.m. to 5:00 p.m. local time (r 9).
