- Rule 2.03(1)(c) general discretion to excuse compliance with a Rule, including to lengthen a period. Note that r 94.03 and Judicature Act s 50 address extension in APPEALS specifically, not judicial review, so the general r 2.03 discretion is the relevant power here.
- Rule 7.05(1) imposes TWO cumulative caps and the earlier governs. This 25-day limb runs from communication to the applicant. The separate six-month limb runs from the making of the decision and is catalogued separately - do not merge them into a single period. Because the Act says 'the earlier of', an applicant who learns of a decision late can be out of time under limb (b) even though limb (a) has not expired. Note also Limitation of Actions Act, SNS 2014 c 35, s 3(b): the 2014 Act does not apply to a claim in a proceeding for judicial review, so the r 7.05(1) caps are the whole of the time bar and no two-year or fifteen-year statutory period runs alongside them.
