- BACKWARD, clear days. Consequences are severe and automatic in substance: under r 12-4(5), unless the court otherwise orders, if NO party of record files a trial certificate the trial must be removed from the trial list; under r 12-4(6), a party who fails to file is not entitled to make further applications without leave. Every party of record must file, not just the party who filed the notice of trial (r 12-4(1)). Corrected on verification: same defect as the trial record entry. Only the "at least 14 days before" limb attracts the Interpretation Act s 25.2(3)(b) uplift; the "not more than 28 days before" limb does not, because it uses neither "clear" nor "at least" nor "not less than". The periods and the window structure are confirmed against SCCR r 12-4(2), as are the consequences in r 12-4(5) and (6).
