- PRECONDITIONS under r 8: a respondent may file a notice of cross appeal only if it has filed a notice of appearance in Form 2, is seeking to vary the order being appealed, and is seeking relief different from that sought by the appellant. Since the notice of appearance is itself due within 10 days under r 7(1), the two deadlines are sequenced inside the same 15 day window. Court of Appeal Act s 14(2): a cross appeal must be treated as an appeal for all purposes of the Act.
