  • A justice may extend under Act s 32(2). Note the two-stage structure: the Form 8 notice within 7 days and the application book within a further 14 days of filing that notice.
  • NON-REVIEWABLE ORDERS. Certain orders may not be varied at all: Court of Appeal Act s 29(2)(a) (an order under s 31 granting leave to appeal) and CA Rules r 62(1) (an order or direction under r 48(1) granting or refusing relief in a case management conference; an order for shorter notice; an order to expedite an appeal). Court of Appeal Act s 35(1)(b) separately bars variation of an order extending or shortening the time limit for commencing an appeal or application for leave to appeal. Check the excluded list before computing. Amended by BC Reg 30/2025, s 3(a).
