  • SAT Rules r 10(1)-(2): the Tribunal may extend any time fixed under the Act, an enabling Act or the rules for commencing a proceeding, on application or on its own initiative, and may do so even if the time expired before the application was made. This is a broad, expressly retrospective extension power.
  • SAT Act s 44(1)(b) allows the executive officer to reject an application made after the time limit, and s 44(3) gives the applicant a right to have that rejection referred to the Tribunal for review. A proceeding commences when the application is ACCEPTED by the executive officer (s 42(3)), not when it is lodged.
