Rule 42.02.2(e) requires the grounds not to depart from those in the application for special leave unless the Court or a Justice otherwise orders. Rule 42.09 confirms that an appeal does not operate as a stay unless the Court or a Justice otherwise orders. Rule 42.17 applies Part 42 timing to an appeal from a Justice's refusal of an application made without notice.
