  • None expressed. The request must be made while the employee is taking unpaid parental leave under s 71 (Note to s 76(2)).
  • Added on verification: the direct counterpart of the s 76A(1) employer response deadline already in this catalogue, without which the engine would report the employer's obligation but not the employee's. A minimum-notice period counted backwards from the end of the available parental leave period, so it yields a latest-valid-request date and no rollover applies. Section 76(7) caps any extension: the employee cannot extend unpaid parental leave beyond 24 months after the date of birth or day of placement of the child. Verified against the Fair Work Act 2009 compilation in force 1 July 2026.
