When is the deadline for application for approval of a greenfields enterprise agreement?

The catalogue records a 14 days period from the day the greenfields agreement is made (s 182(3): when signed by each employer and each relevant employee organisation). This draft page remains free only until its source, worked example and limits are reviewed.

  • NONE. Section 185(4) contains no extension power, in deliberate contrast to s 185(3)(b) which allows the FWC to extend the equivalent non-greenfields period where fair. This period is expressly non-extendable on the face of the provision. Flag prominently; do not offer an extension calculation.
  • By s 185(6), s 185 does not apply to an agreement made under s 182(4) (the greenfields route where the notified negotiation period has ended); in that case the agreement is taken to be made when the approval application is made, so no separate 14-day period arises. Section 185A prescribes the accompanying material for a s 182(4) application.
