- Two competing limbs: within 3 months after the appeal is brought (r 40(2)(a)) or not later than 30 working days before the allocated hearing (r 40(2)(b)), whichever is earlier. The 3-month period is extended by the number of days falling in 25 December to 15 January (r 40(6)) and rolls to the next working day if it expires on a non-working day (r 40(7)).
