Rule 5(3)(a) of the HESC Rules 2008 permits the tribunal to extend time only where doing so would not 'conflict with a provision of another enactment containing a time limit', and s.77(1) MHA 1983 provides that 'No application shall be made to the appropriate tribunal by or in respect of a patient under this Act except in such cases and at such times as are expressly provided by this Act.' An out-of-time s.2 application is a jurisdictional bar, not a curable irregularity.
