  • Rule 37(4)(b) contains an express power to give shorter notice with the parties' consent or in urgent or exceptional circumstances. Consent-based abridgement is common where a hearing is brought forward at the patient's request. Also extendable or shortenable under Rule 5(3)(a).
  • TWO DIFFERENT COUNT TYPES IN ONE RULE. The general period is 21 CALENDAR days; the s.2 period is 3 WORKING days, where 'working day' is defined in rule 1 as 'any day except a Saturday or Sunday, Christmas Day, Good Friday or a bank holiday under section 1 of the Banking and Financial Dealings Act 1971'.
