- Administrative practice, not a statutory period. Practice guide 37 states "We will not usually extend the period allowed for negotiations unless exceptional circumstances justify our doing so." The period may also be cut short: the guide says the matter will be referred to the tribunal "after 3 months of the negotiation period has elapsed and it is obvious that agreement will not be reached".
