- Expressly variable: the rule opens 'Unless the High Court otherwise directs'. Section 31(4) adds that 'The High Court may extend the relevant period if it believes it to be in the interests of justice to do so; and this subsection may apply more than once', and s.31(5) permits that power to be exercised even after the period has expired. Extensions are routine, because 40 days from arrest is very often unachievable for a contested appeal. Never treat 40 days as the real listing date.
