  • No express sanction in r.47.19. Extension under CPR r.3.1(2)(a). In practice these assessments (trust funds, estates, Court of Protection style funds) are routinely requested late without consequence, but delay may attract adverse comment on the assessment itself.
  • Used where costs are payable out of a fund other than the Community Legal Service Fund. The court provisionally assesses without attendance unless it considers a hearing necessary (r.47.19(4)), and will fix a hearing if the receiving party asks within 14 days of receiving the provisionally assessed bill (r.47.19(6)).
