And the window can close at any moment - r.47.9(5): "If any party (including the paying party) serves points of dispute before the issue of a default costs certificate the court may not issue the default costs certificate." There is no outer time limit on requesting.
- This is a hard gate (earliest date), not a deadline. The request is made in Form N254 and must be accompanied by a copy of the document giving the right to detailed assessment (PD 47 para 10.1). Fixed costs on issue are £80 plus the court fee (PD 47 para 10.7). Default costs certificates do not apply to solicitor-and-client assessments under r.46.10 (PD 46 para 6.8).
