- Not an absolute bar, but a substantially raised threshold: the client must establish "special circumstances". This is a real hurdle, not a formality, and the burden is on the applicant. Where an order is made the court may impose terms as regards the costs of the assessment. Never treat this as an ordinary extension.
- Marked binding because crossing 12 months from delivery changes the legal test rather than merely inviting an extension. The 12-month restriction applies only to an application by the party chargeable, not to an application by the solicitor. Note that the three limbs of s.70(3) are alternatives, so a client can be caught by limb (b) or (c) well inside 12 months from delivery.
