- None on the court's part within the month: the statute says the court "shall" order assessment, without security and without terms. There is no power to extend this window - once the month expires the client falls into the discretionary regime in s.70(2) and, later, the restricted regimes in s.70(3) and (4). This is the most valuable date to diarise on receipt of a solicitor's bill.
- The one month runs from DELIVERY of the bill, not from receipt of the underlying invoice or from any earlier estimate. Missing it does not end the client's rights but converts an entitlement into a discretion, and exposes the client to terms (including payment into court).
