- "Special circumstances" must be shown, and the court may impose terms as regards the costs of the assessment. Payment itself is the trigger, so the restriction can bite immediately on payment even if the bill was delivered only days earlier.
- Important interaction: payment triggers the s.70(3)(c) special-circumstances test at once, and simultaneously starts the absolute 12-month bar in s.70(4). So a client who pays a bill has at most 12 months from payment, and even within that window must show special circumstances. This is the trap most often missed on solicitor-and-client bills.
