- Wholly discretionary, but the discretion is exercised readily where the creditor has pursued execution and there is no prejudice. Unlike most renewal regimes there is no cap on the number of extensions ('from time to time'). Timing matters: applying BEFORE expiry gives a seamless extension running from the day after expiry, whereas applying after expiry leaves a gap and the start date is at the court's discretion. Always diarise the application to land before expiry.
