  • On the face of s.57(4) the period is extendable only by agreement of the parties. The court may also extend under s.79, but only on the s.79(3) test that arbitral recourse has been exhausted and a substantial injustice would otherwise be done.
  • Two reasons to diarise this alongside the s.70(3) date. First, s.70(2)(b) bars a s.67, s.68 or s.69 application unless available recourse under s.57 has been exhausted. Second, since 1 August 2025 a material s.57 application resets the challenge clock under s.70(3A)(b) and (c). s.57 applies only if or to the extent the parties have not agreed their own regime (s.57(1)-(2)), and
