- The Court may grant an extension of time for service on application, which may be made without notice, before or after the expiration of the time for service (r 3-10(2)). Any extension must be marked on the statement of claim and dated and signed by the local registrar (r 3-10(3)).
- Months are counted as calendar months (r 13-5; Legislation Act s 2-28(7), (9)). Failure to serve in time means no further proceeding may be taken against that defendant (r 3-11(a)). An Act may prescribe a shorter service period - all enactments relevant to the cause must be checked (Information Note to r 3-10).
