- NON-EXTENDABLE BY AGREEMENT: s 21(2) expressly prohibits an agreement extending the s 7 ultimate period. No judicial discretion to extend. The period IS suspended during minority or unrepresented mental incapacity (s 8(1)) and during wilful concealment or wilful misleading by the defendant (s 17), because those provisions suspend "any limitation period established by this Act".

MUST BE RECORDED SEPARATELY FROM THE SECTION 5 BASIC PERIOD - the two run independently and the claim is barred on the earlier expiry. Subsections (2) and (4) displace the 15 years for particular claims: conversion against a good faith purchaser for value is 2 years from conversion (s 7(2)); a claim based on an act or omission causing death is 2 years from the earlier of discovery of the death and the date of a court's presumption of death (s 7(4)).
