- Wording is "not later than ... before", which does not literally engage the clear-days rule in Legislation Act s 2-28(4); s 2-28(2) excludes the pre-trial date and the tenth day back is the last permissible day. Saskatchewan practice commonly treats it as a clear-day period - compute conservatively. Note also the immediate obligations in r 5-10(1)(a) and (b) to give notice and supply a copy as soon as the document is found.
