- Rule 6(1) extension or abridgment. Leave of a judge or the Registrar on motion is required to cross-examine at all (r 90(1)), and the notice requiring production of the deponent must be served within the time the judge or Registrar may order (r 90(2)) - that period is set by order, so r 5(4) means holidays and July are counted for it.
- Any cross-examination must take place before the proceeding is heard unless a judge or the Registrar otherwise orders (r 90(3)). If a deponent is not produced for cross-examination the affidavit shall be struck out unless a judge or the Registrar otherwise orders (r 90(6)).
