  • MONTHS ARE COMPUTED UNDER INTERPRETATION ACT s 28, not by counting days: count forward the number of months without including the month in which the trigger day falls, exclude the trigger day, and include in the last month counted the day with the same calendar number as the trigger day, or the last day of that month if there is no such day. Costs are taxed party and party under the Schedule B tariff unless the Court otherwise orders (r 83(1)). On discontinuance or dismissal as abandoned, a respondent may tax costs without a further order (r 85(a)).
