Calculation basis and source
- Period
- 7 days
- Trigger
- The hearing date of the motion
- Counting
- The encoded calculator method must be independently documented before publication.
- Rollovers and holidays
- Holiday, closure and order treatment must be independently documented before publication.
This route remains in preparation until a pinpoint official source is recorded.
- r 3.02(1) court may lengthen or shorten; r 3.02(2) by filed consent.
- BACKWARD, and unlike the identical-looking seven-day period in RCP r 37.07(6), holidays ARE counted here because O Reg 258/98, r 3.01 has no short-period exclusion. The real-world reach-back is therefore seven calendar days, not eleven. This is the single most likely cross-court miscalculation in Ontario.
