When is the deadline for successful party's draft order to each other party?

  • Rule 78.04(3) applies only "in the absence of directions"; a judge who settles the order or gives directions for settlement under r 78.04(2) displaces the whole timetable. Rule 2.03(1)(c).
  • ADDED ON VERIFICATION. The first of three linked post-decision deadlines in r 78.04(3): ten days for the successful party to circulate the draft under (a), five days for the receiving party to object or consent to form under (b), and twenty days from communication of the decision for the successful party to deliver the draft to the judge under (d). Getting the order issued matters for appeal purposes, because r 90.13(3) runs the appeal period from the date of the order and r 90.15 requires the order to be filed before the appeal is set down for hearing.
