  • Rule 4.04(3): the motion may be made ex parte, unless a judge orders otherwise. Rule 4.04(6) governs once the fourteen months have run and requires the plaintiff to satisfy the judge on one of the two narrow grounds set out there.
  • ADDED ON VERIFICATION. The fourteen-month figure gives a plaintiff two months of grace after the one-year expiry in r 4.04(1) in which to bring a renewal motion as of course; after that the much harder r 4.04(6) test applies. Expressed in months, so r 94.02(1) does not apply and the count is calendar months. Verified against the Official Consolidated Civil Procedure Rules, consolidation of 19 June 2026, published by the Courts of Nova Scotia.
