- Rule 2.03(1)(c) - a judge may excuse compliance with a Rule, including to shorten or lengthen a period provided in a Rule. Rule 23.11(2) permits a SHORTER lead time, not an earlier one: "A party who certifies on a notice of motion that no party will oppose the motion may file a notice of motion, draft order, supporting affidavit, and supporting brief two days before the motion is to be heard." Rule 23.12(1): a party may only file an affidavit after a Rule 23.11 deadline with the permission of a judge.
- Backward period. The supporting affidavit and supporting brief share the same 5-day deadline in this column. Under r 94.02(1) this is 5 clear working days before the hearing, which for a Monday hearing with no holidays means filing by the Friday of the week before last. Corrected on verification: the research draft described r 23.11(2) as permitting "earlier filing on an unopposed motion certified as such". It does the opposite. On a certified unopposed motion the material may be filed as late as two days before the hearing, shortening the lead time from five days to two (Nova Scotia Civil Procedure Rules, r 23.11(2), Official Consolidated Rules, 19 June 2026).
