The limitation does not apply where the ground is that the by-law was required to be put to a vote of voters and the vote was not conducted or the by-law was not approved, that notice of an intention to pass the by-law was required but not given, or that a required public hearing was not held (s 383(2)).
  • Applies only to the s 382(1)(d) ground (failure to comply with a requirement of the Act or the municipality's procedures by-law). Applications on the grounds of excess of jurisdiction, bad faith or discrimination under s 382(1)(a)-(c) are not caught by this one-year bar.
