- No extension power in the Act; s 7(4) is an absolute bar ("but no such action shall be brought thereafter"). Because The Limitations Act, CCSM c L150, s 4(1)(a) excepts ss 13 and 14(1), the suspensions for minors and persons under a disability still operate.
- ADDED ON VERIFICATION: this was missing from the researched catalogue and is a serious omission for a Manitoba deadline calculator. The period runs from the DEATH, not from discovery, so it is not the two-year discovery period in The Limitations Act, CCSM c L150, s 6; s 4(1)(a) of that Act disapplies the general regime to a claim subject to a limitation provision in another Act. Section 7(3) separately provides that a dependant is not barred merely because the deceased could not have sued at the date of death by reason of lapse of time or failure to meet a statutory or contractual condition. Computation is under The Interpretation Act, CCSM c I80, s 22(4) (the specified day is excluded) with rollover under s 24(1) and s 24(2); King's Bench r 3.01 does not apply.
