- Leave of the court permits filing at any time under r 3-5(4)(a); r 3-5(5) allows the court to consider and amend any case plan order when granting leave. The court may also extend under r 22-4(2). Never compute leave.

The separate limitation period for contribution or indemnity under Limitation Act ss 16 and 21(2)(c) runs independently and is the harder bar.
