- Note the trigger is FILING of the defendant's own defence, not service on it. The Form 15 notice under the Tort-feasors Act or the Contributory Negligence Act removes the need for a third party claim against the co-defendant (r 3.43(1)(c)) and no pleading need be filed on the claim unless ordered. Separately, the substantive limitation period for contribution is in Limitations Act s 3(1.1) and runs independently of this rule.
