Judicial review applications follow r 3.15(5) instead, which requires one month or more. Corrected on verification: the researched entry said that "Judicial review applications follow r 3.15(5) instead". That overstates the carve-out and could cause an originating application for judicial review to be served too late. Rule 3.9 is displaced only "Except as otherwise provided in rule 3.15(5)", and r 3.15(5) governs only the "affidavit or other evidence to be used to support" the judicial review application, which needs one month or more. The originating application for judicial review itself is still caught by the r 3.9 10 day service requirement, in addition to the separate r 3.15(2) requirement that it be filed AND served within 6 months of the decision.
