A case management officer may fix, revise, extend or shorten the times for taking steps in an appeal under r 14.36(1) read with the Court of Appeal Act, RSA 2000 c C-30, s 14(2)(c)(iii).
- A respondent generally does not need permission to cross appeal a r 14.5 decision if the cross appeal only seeks to vary the decision already under appeal (r 14.6(2)), but must apply for permission where an enactment makes the appeal permission-based (r 14.6(3)). Corrected on verification: the researched entry located the case management officer's extension power in r 14.36(b). Rule 14.36 was replaced by AR 126/2023 and no longer has clauses (a) and (b) or any list of extension powers. It now provides only that a case management officer may assist the Court "as authorized by section 14 of the Court of Appeal Act". The power to "fix, revise, extend or shorten the times for taking steps in an appeal" is in Court of Appeal Act, RSA 2000 c C-30, s 14(2)(c)(iii).
