- Restoration may be by filed written consent of the parties or by order of a single appeal judge, on payment of the Schedule B fee (r 14.65(1)). Party agreement to extend the period itself is barred by r 14.2(3).
- TWO REQUIREMENTS, not one: the application must be filed and served AS SOON AS REASONABLY POSSIBLE (r 14.47(a)) and must be RETURNABLE within the 6 months (r 14.47(b)). Under r 14.65(3) the application must additionally have been GRANTED within that window or the appeal is deemed abandoned. A restored appeal that misses the new deadlines set on restoration is deemed struck again (r 14.65(2)).
