- "Not less than" engages Interpretation Act 1984 (WA) s 61(1)(f): both the day of service and the return day are excluded. Because the period is 7 days and not fewer, the short-period rule in RSC O 3 r 2(2) does NOT apply - non-business days are counted. Corrected on verification: the pinpoint was given as O 14 r 1(3), but O 14 rule 1 ("When plaintiff may apply for summary judgment") has only subrules (1) and (2) and contains no service period; the 7-day service requirement is in O 14 rule 2(3) ("Application under r. 1, how to make").
