  • None. The section is expressed as an absolute prohibition on the making of an enforcement order - "must not be made". Unlike the 6-year leave requirement in s 13(1)(a), there is no provision for leave beyond 12 years.
  • Applies only to judgments taking effect after the commencement of the 2004 Act. Runs from when the judgment TOOK EFFECT, not the date of the hearing or the date the order was drawn up. Distinguish this from any Limitation Act 2005 period for bringing a fresh action on the judgment.
