- O 3 r 5 extension power, exercisable after expiry. Note O 65 r 1 defines "interim order" so as to exclude an order extending "the time for commencing an appeal" from the ordinary interim order jurisdiction, so an extension is sought as a substantive application.
- O 65 applies to any appeal or application for leave to appeal to the General Division other than a Criminal Appeals Act 2004 Part 2 appeal, and is subject to the written law under which the appeal is made (O 65 r 2(2)) - always check the enabling Act for a different period.
