- A notice of appeal under r 77.06.2(2), being an appeal from an order dismissing an application made without notice, shall not be served (r 77.06.4(2)). A Judge of the Court may direct that notice be served on any party or on a person not a party (r 77.06.4(3)).
- Added on verification: r 77.06.4(1) of the Supreme Court (General Civil Procedure) Rules 2025 imposes a service deadline that has no counterpart in the revoked 2015 Rules, under which r 77.06.2 set the time for service and r 77.06.4 set no period. Because this is a period of 5 days or less, r 3.01(4) applies and every day on which the office of the Court is closed falling within the period must be excluded.
