  • Sections 5 to 33 fix and modify the time of accrual in particular cases (future estates, forfeiture, mortgages, tenancies, acknowledgment under s 21, concealed fraud under s 25). Section 45 (legal disability, 30-year cap) applies. Section 28 extinguishes the right at the end of the period.
  • FIFTEEN years in SA, longer than most Australian jurisdictions. Section 28 extinguishes title at expiry rather than merely barring the remedy, so the accrual analysis under ss 5 to 33 is critical.
