- Corrected on verification: the researched entry stated that the 'preparation commencement date' is defined in r 2.1 as a date 'to be determined by the Court' and is 'not derivable from a fixed event'. That is a misreading of the definition. The r 2.1 definition reads: 'preparation commencement date in respect of an appellate proceeding to be determined by the Court of Appeal means- (a) if leave to appeal is required-the date when leave to appeal is granted or referred for hearing at the same time as the appeal; or (b) in any other case-the date of institution of the appellate proceeding.' The words 'to be determined by the Court of Appeal' qualify the appellate proceeding, not the date. The date is therefore derivable from an identifiable event and the period is computable, most commonly from the date the appeal was instituted.
